BS13968 5GHz radio lots of bugs WRT610Nv2

Description
If I set WL1 to 'mixed' mode, and power cycle (very important part is power cycle), it is impossible to change channels (locked on 34-46). It also says it is using 40MHz mode, but it is NOT. If I set it to N only (5GHz), I get 300 errors at a time; It seems the only way to get it to half work is this
Boot the router WL1 in 40MHz mode using 'NA mixed', channel 'auto' (seems to be the only way to keep 40MHz channel in NA Mixed) then manually change channels on the router, then WDS works! Once the router is power cycled, all hell breaks loose on the 5GHz radio again
The problem with this router is 100% with the way DDWRT initializes/uses the 5GHz radio on the WRT610N....no doubt in my mind now
The WL1 interface on WRT610N needs an overhaul....big time!

When I look at wireless status, on the main router which has internet, it shows 0 TX errors, but on the WDS node, I see only 4 tx ok, hundreds of tx errors, and 0 received tx there is 0 and 0...seems like it is trying to do both things on the tx....why is there no RX?
